New Hyde Park NY Probate Lawyer Nassau County Estate Administration Attorney New York When a loved one has passed away, all of their assets and liabilities must be administered in conformity with certain provisions of law. This task is simplified, and often less costly, if the decedent had the foresight to develop a comprehensive estate plan and execute a valid will. Whether they did have a valid will or died intestate, however, guidance and direction by an experienced estate attorney is almost always necessary.

Guidance for Administrators and Executors of New York Estates

No one can administer the assets of a decedent without court authorization. Without a will, the court must appoint an administrator for the estate. Even when there is a will, the court must confirm that the document offered is the decedent’s last will (a process called “probate”) and then empower the executor named in the will to act.

After appointment, the administrator or executor—the fiduciary of the estate—must pay the estate’s debts and expenses as well as inventory the assets, value them, and either sell or distribute them in accordance with the provisions of the will or applicable law. There are also tax returns to be prepared and inventories and accountings to be filed with the court. In each step of this process, there are choices to be made by the fiduciary which can have significant economic consequences to the beneficiaries of the estate.

Frequently, the decedent created one or more trusts while he was alive, and his will may have created more. The executor must work with the trustees to insure that each trust is properly and timely funded with the assets that are most suitable to fulfill the intended purpose of the trust. When the estate owns hard-to-value assets, such as closely held business interests, artwork, or antiques which are not easily sold, the fiduciary must be sure that their value is properly determined.

All this work must be completed within the time periods specified by law.
